TERMS AND CONDITIONS – Tox Memberships

ELITE Monthly Membership

  • Toxin Allocation: Members receive 64 units of FDA-approved dosing every 90 days, ensuring consistent access to toxin treatments for a smoother, more youthful appearance.
  • Monthly Subscription Fee: The monthly subscription fee is $235, providing members with 21.33 toxin credits each month. After their third billing date, members can access and utilize their accumulated 64 units of toxins.
  • Immediate Usage Option: If a client wishes to sign up for the membership and use it immediately, they have the option to do so. However, in such cases, an upfront payment of $705 will be billed.
  • Annual Membership Benefit: Elite members who pay their annual membership fee in full ($2820) will receive an immediate allocation of 256 units in their account, allowing them to use 64 units every 90 days. These units are equivalent to a standard Botox unit. As an exclusive bonus, Elite members who opt for the full-year upfront payment will also enjoy a complimentary syringe of filler, enhancing the value of their membership.
  • Membership Terms: Please note that these terms and conditions are subject to change, and members will be notified of any updates accordingly.
  • Usage Requirement: To maintain your membership privileges, members must utilize their allotted 64 units of toxin credits every 90 days. Failure to do so may result in the loss of membership credits.
  • Filler Redemption: Any complimentary syringe of filler included in your membership must be used within 365 days of membership sign-up.
  • Renewal Policy: By signing up for a monthly membership plan, you acknowledge that your membership will continue to automatically renew each month until you properly cancel or we terminate your Agreement, with the same amount billed to the credit card on file. Annual memberships will not automatically renew unless the client gives permission to do so.

Usage Guidelines:

  • Membership units are exclusively for upper-face toxin treatments.
  • Elite members receive 21.3 monthly tox units, redeemable at the 90 day mark. Unused credits will expire and are non-redeemable after the specified timeframe and will be considered forfeited and lost. We do not issue refunds fo unused toxin credits. 
  • Appointments are subject to availability – HSS is not responsible for scheduling difficulties if you forfeit to timely schedule an appointment.   

Cancellation and Refund Policy:

  • Monthly members may cancel anytime; unused credits expire upon cancellation.
  • Annual members may cancel only upon membership renewal, with credits available until the end of the membership year.
  • Three-day right of rescission: Cancel within three days for a refund, minus the value of any received services during the period.

Additional Terms:

  • Honey Skincare Studio reserves the right to cancel or revoke a membership at any time.
  • Price increase: Reasonable notice will be provided for existing members upon renewal.
  • Equipment closure: No credit or refund during equipment maintenance.
  • Additional treatments: Members can purchase and apply discounts towards additional services (excluding packages).

GENERAL TERMS AND CONDITIONS

1. OVERVIEW

Before you get started with your first Honey Skincare Studio (“HSS”) membership services, please read these Terms of Service (“Terms”) carefully. These Terms are intended to apply broadly and, whether we consider you a Member or a Guest (as these terms are defined below), they will govern your (a) access to the HSS website (www.honeyskincarestudio.com) (“Site”) and mobile application (“App”); (b) entry to our HSS studio location; or (c) your purchase of a product or service sold or provided by us. By accepting the benefits of our membership services, you hereby agree to these Terms. If you do not agree to these Terms, then you may not use our membership services. Your acceptance of these Terms shall include any additional terms, conditions, hyperlinks or policies referenced herein. 

2. PARTIES TO THE AGREEMENT

These Terms, together with the information contained in your membership receipt (if you are a Member) and/or Liability Waiver (if you are a Member or a Guest), constitute your “Agreement” with Honey skincare studio, “HSS’, “we,” “us” or “our”. Your Agreement is with the HSS Studio. By receiving Services, you acknowledge that HSS, and its past, present and future affiliates and subsidiaries, and their respective officers, directors, incorporators, members, partners, owners, agents, management, controlling parties, entities under common control, vendors, service providers, attorneys, employees or representatives (collectively, the “HSS Entities”) shall have no obligation to provide you with Services and further shall have no liability under your Agreement with HSS, including without limitation, these Terms. 

3. CHANGES & CORRECTIONS

You can always review the most recent version of these Terms on the Site. We reserve the right to update, change or replace any part of these Terms by posting updates to the Site or sending you email notice of any such change. It is your responsibility to check the Site periodically for any changes to the Terms. Your continued access to the Site or use of Services following the posting of any such change constitutes your acceptance of the changes. There may be information on the Site or App that contains typographical errors, inaccuracies or omissions that may relate to Services, including descriptions, pricing, availability and other information. We reserve the right to correct any errors, inaccuracies or omissions and to change or update the information on the Site or App at any time, without prior notice. 

4. SERVICES 

We strive to offer a variety of modern and state-of-the-art med-spa corrective and enhancing treatments. A list of Services is posted at our website and HSS app. We reserve the right to change or discontinue Services at any time or adjust the price for Services. Services, once used, are non-refundable. Services may be sold a-la-carte, as a prepaid package, or through a membership plan. Certain Services may be subject to additional terms and conditions.  

5. MINORS

We do not offer or provide toxin services, vitamin shots or IV therapy to anyone under the age of 18.

6. MEMBERS & GUESTS

We make Services available to both Members and Guests. We consider you a “Member” if you purchase Services through a membership plan. We consider you a “Guest” if you purchase Services outside of a membership plan, which could include being a walk-in or purchasing Services on an a-la-carte or prepaid package basis. Whether you are a Member or Guest, these Terms will apply to your receipt of Services. Members, however, will be subject to the additional terms and conditions for Memberships described below.  

7. APPOINTMENT BOOKINGS 

Although we accept walk-ins for Services on a first-come-first-serve basis, you are strongly encouraged to book an appointment for Services. It is your responsibility to book appointments for Services through the channels provided, which include in-person (at the HSS Studio location), by phone, through the App or through the Site. Once you have booked your appointment for Services, you will be considered “locked in” to the appointment. If you must cancel or reschedule your booked appointment, you must do so as soon as possible. HSS upholds a cancellation policy requiring 48 hours before the cancellation of your treatment. If you do not cancel 48 hours in advance or not show for your appointment, we will charge $50 for Injectable services. 

You agree that the late cancel and no-show fees are reasonable, and you authorize us to charge you, where applicable, to the payment method on file. If you have a membership service scheduled and you are subject to paying a late cancel or no-show fee, you will not lose a credit in addition to paying the late cancel or no-show fee. 

As a courtesy to other Members and Guests, we will begin and end all booked appointments at their scheduled times. We will not extend the time if you show up late for a booked appointment. To maximize your benefits, we recommend that you arrive early to get checked in and prepare for receiving Services. 

8. STUDIO RULES

Honey Skincare Studio Rules are subject to change, at our sole discretion. Services offered, hours of operation, rules for proper attire, and other rules related to your receipt of Services or access to HSS are subject to change and will be set by HSS.

9. GIFT CARDS

Purchasing a gift card is not the same thing as purchasing a membership or a prepaid package for Services. Gift cards are subject to their own terms and conditions, as may be posted on the gift card itself.  Your use of Services purchased through a gift card will still be subject to these Terms.  Member discounts are not applicable to gift card purchases. Gift Cards cannot be used towards membership payments.  

10. NO PETS

Unless you have a registered service animal, no pets will be permitted inside of our Honey Skincare Studio location. We have this policy to maintain a hygienic and stress-free environment within which to receive Services.

11. LOSS OF PROPERTY

We are not responsible for the disappearance, loss, theft or damage to personal property you bring to Honey Skincare Studio or the surrounding premises. You are encouraged to leave any valuables at home.

12. RETAIL

Products may be returned for spa credit within 14 days of purchase. No refunds for products returned after 14 days. No refunds for opened & used products. No refunds for gift certificate purchases. May be exchanged for equal valued service/product.

13. PACKAGES

Member discounts are not applicable to packages. 

14.1 MEMBERSHIP – FLEXIBILITY 

  • Member Discounts: Members can share their discount with a new client on the day of their appointment, applicable to all services and products.
  • Plan Changes: Members can upgrade their plan anytime. Downgrades are allowed after the initial commitment period (12 months for Elite Tox Membership).
  • Service Extensions: For the Elite tox Membership, appointments should be pre-scheduled every 90 days.
  • Promotions: Discounts cannot be combined with other offers. Free monthly Vitamin or B12 shots available at time of service. 
  • Service Rollover: Missed services / tox credits do not roll over to the next month.

14.2 MEMBERSHIP – CANCELLATION POLICY

  • Standard Cancellation: You can cancel your membership after fulfilling the initial commitment period:
    • 6 months cancellation period –  ESSENTIAL TOX Membership
    • 12 months cancellation period – ELITE TOX memberships. 

To cancel your membership, send us a written notice at least 60 days in advance to info@honeyskincarestudio.com. After submitting your cancellation notice, you can still use any remaining benefits until the end of the last billing cycle, which is usually within 60 days from when you notified us.

  • Unused Benefits: You are not entitled to any refund for/or reinstatement of any late canceled or missed Treatment. Treatments have no cash value and are non-transferable.
  • Early Termination Rights: You’re allowed to cancel your membership before the end of your commitment period for specific reasons such as death, serious illness or injury, pregnancy, moving more than 30 miles away from our location, or if you’re called to active military duty and deployed outside the state. You’ll need to provide documentation (like a doctor’s note, lease agreement, military deployment orders, etc.) to support your early cancellation request.
  • Early Termination Fees: Will be charged to the card on file.
    • $250 for ESSENTIAL TOX membership
    • $500 for ELITE TOX membership

14.3 MEMBERSHIP – FREEZE POLICY

  • Eligibility for Freeze: You can temporarily freeze your membership for reasons such as illness, injury, pregnancy, or a short-term military assignment. Proof (e.g., doctor’s note, military orders) is required.
  • Request Procedure: Submit a freeze request via email to info@honeyskincarestudio.com at least 30 days before your next billing cycle. The request should include the reason for the freeze and any supporting documentation. Your account must be active and in good standing to qualify.
  • Freeze Fees and Billing: A recurring freeze fee of $50 applies and will be monthly charged to your card on file. During the freeze period, regular membership billing will be suspended and will resume once the freeze period concludes. 
  • Duration: Membership can be frozen for up to 3 months for medical reasons or 9 months for pregnancy.
  • Billing Suspension: Billing of regular membership fees pause during the freeze period and resumes automatically once the period ends. We may end the freeze early at our discretion, resuming regular fees.
  • Impact on Membership Term: Freezing your membership will extend the original end date of your membership term by the duration of the freeze period. This ensures that you receive the full term of membership benefits to which you are entitled, despite the temporary suspension.

15. LOYALTY POINTS

  • No loyalty points can be earned off membership and / or discounted services. 

16. YOUR ACCOUNT

  • Account Security:You are responsible for all activities conducted under your account in the App and online. Ensure your login credentials and passwords are kept secure and do not share your login details with any third party.
  • Billing Profile Accuracy: It is your duty to keep the billing information associated with your account accurate and current.
  • Payment Information: You must have a valid payment method on file at all times.
    • Accepted payment methods include:
      • Debit cards
      • Credit cards (VISA, Mastercard, American Express, etc.)

17. PAYMENT AUTHORIZATION

  • Authorization for Charges: By using our Services, you give HSS and its authorized third-party payment providers the right to charge your payment method on file for all fees, charges, and other amounts owed, on or after each due date. Charges may not be immediately reflected on your card.
  • Multiple Payment Methods: If a charge fails on one card, you authorize us to try other cards you’ve provided.
  • Failed Payments: For payments returned unpaid, and if a valid card isn’t provided within 10 days after the due date, we reserve the right to:
    • Suspend your membership
    • Deny Services
    • Terminate your Agreement
    • Apply a $35 late fee
  • Additional Fees from Financial Institutions: You may incur fees from your bank for any dishonored payments, for which HSS bears no liability.
  • Revoking Authorization: You can cancel this payment authorization by:
    • Visiting us in person
    • Calling
    • Emailing
    • Mailing a letter
  • Ensure to give us enough notice (typically three business days) to process your request.
  • Responsibility for Payment: Canceling payment authorization doesn’t waive your obligation to pay any amounts you owe under the Agreement.
  • Default on Payments: In case of payment default, we can demand immediate payment of the full balance and may seek recovery of costs, including reasonable attorney fees, for collecting outstanding amounts.

18. RIGHT TO DENY SERVICES

We reserve the right to deny Services, terminate a membership, or restrict (or completely bar) access to our HSS location for any reason not expressly prohibited by law.  

19. THIRD PARTY WEBSITES AND CONTENT

The Site and App may feature links and content (like photos, articles, and videos) from third-party websites and sources, which we do not verify for accuracy or endorse. We’re not responsible for the content or purchases made through these third-party sites. You should check their terms and privacy policies before engaging. By using our Site or App, you agree that we’re not liable for any issues that arise from these third-party interactions.

20. DISCLAIMER OF WARRANTIES 

By using the site, app, their content, or any services offered, you acknowledge and accept that everything is provided “AS IS” and “AS AVAILABLE,” with no guarantees of any kind. HSS explicitly disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, quality, fitness for a particular purpose, accuracy, and non-infringement. HSS cannot guarantee that the site, app, or services will meet your needs, operate without interruptions or errors, or that any faults will be corrected. Note that some jurisdictions do not allow the waiver of implied warranties, so this disclaimer may not apply everywhere.

21. LIMITATION OF LIABILITY

In no event will we, our directors, employees, agents, or hss be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, lost revenue, loss of data, or other damages arising from your use of the site, the app (and any content or information contained on any of them), or any services, even if we have been advised of the possibility of such damages. your sole remedy is to cease use of the site, the app, or services. certain state laws do not allow limitations of implied warranties or the exclusion or limitation of certain damages. if these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.

22. INDEMNIFICATION

By using our Site or App, you agree to protect, indemnify, and hold harmless our company, including its subsidiaries, affiliates, officers, agents, partners, employees, and HSS Studio from any third-party claims, damages, liabilities, or costs (including attorney fees) arising from your use of the Site or App, any breach of the Agreement or Terms, infringement of third-party rights, violation of laws, or any harmful actions towards other users. Although we reserve the right to manage our defense and any related expenses, you must cooperate with us in defending against such claims. We will make an effort to inform you of any claims that require your indemnification.

23. DISPUTES

If a dispute of any kind arises, we want to understand and address your concerns quickly and to your satisfaction. Please contact HSS directly with any dispute, either in-person or at the HSS’s email address info@honeyskincarestudio.com. If we cannot resolve your concerns, the parties agree to an informal dispute resolution process requiring individual arbitration.

24. BINDING INDIVIDUAL ARBITRATION

By agreeing to this arbitration clause, you consent to resolve any disputes related to the Agreement or Services exclusively through binding arbitration by the American Arbitration Association (AAA), or another forum if the AAA is unavailable. This agreement waives your right to litigate claims in court, including participating in class actions, unless you opt out within 30 days of entering the Agreement. All claims, except for excluded claims like intellectual property disputes, non-payment issues, or those requiring injunctive relief, will be arbitrated on an individual basis. The arbitration will be conducted by a single arbitrator, limited to the dispute between you and HSS, and will not be combined with other arbitrations or conducted as a class action. The losing party in arbitration must cover the fees and reasonable attorney’s costs of the prevailing party, and the arbitration outcome will be final and binding, with the ability to enter judgment in a competent court.

25. ELECTRONIC COMMUNICATIONS & SIGNATURES

By using our Services, you consent to accept all forms of communication from us—including agreements, notices, disclosures, and other messages—through electronic means such as email, or directly on our Website or App, as fully meeting the legal standards traditionally reserved for written documents. You agree to the use of electronic signatures and the electronic receipt of all notices, policies, and records of transactions we conduct or that are carried out through our Website or App. Additionally, you relinquish any entitlements or demands set forth by any laws across jurisdictions that necessitate an ink-and-paper signature, non-digital record-keeping, or non-electronic transactions and credits. This consent streamlines our interactions and acknowledges the validity and legality of our digital communications.

26. GOVERNING LAW & VENUE

The Agreement shall be interpreted under the laws of the state in which you execute it.  Any Claim related to Services or the Agreement shall be resolved by an arbitration tribunal or by a court of competent jurisdiction in the state where HSS is located and you agree to submit to this jurisdiction.

27I . GENERAL PROVISIONS

  • The Agreement, including these Terms and any applicable Studio Rules, constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of the Agreement (including, without limitation, these Terms) shall not operate as a waiver of such right or provision. 
  • The Agreement (including, without limitation, these Terms) shall operate the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time without your permission. 
  • We shall not be responsible for any loss, damage, delay or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of the Agreement (including, without limitation, these Terms) is determined to be unlawful, void or unenforceable, that provision or part of the provision is deemed severable from the Agreement and does not affect the validity or enforceability of any remaining provisions. Where context requires, the singular shall include the plural, the masculine gender shall include the feminine and neuter gender, and “and” shall also include “or.” 
  • There is no joint venture, partnership, employment or agency relationship created between you and us as the result of your use of the Site, the App or any of the Services. You agree that the Agreement (including, without limitation, these Terms, will not be construed against us by virtue of having drafted it. 

FAQs

  • Utilizing Fewer Than 64 Units: While the FDA recommends 64 units for upper face treatments, you’re allowed to use fewer. However, please be aware that any unused units will not carry over to future sessions.
  • Allocation of Units: The ELITE membership is exclusively for treatments on the upper face (crow’s feet, frown lines and forehead lines). Should you wish to address other facial areas, additional units can be purchased at a discounted rate.
  • Included Treatments in ELITE TOX Membership: The membership covers all types of tox treatments for the upper face – Botox, Dysport, and Xeomin, and Daxxify. This specifically targets frown lines, forehead lines, and crow’s feet.
  • Quantity of Tox for Upper Face: The FDA has approved a dosage of 64 units for the upper face area, applicable every 90 days.
  • Redeeming the Free Syringe of Filler: Members who have paid their annual fee in full are entitled to utilize their complimentary syringe of filler whenever they choose.
